Calculating Federal Good Time Credit and the time of a federal prison sentence to be served
There are four variables involved in calculating a federal prison.
1.Good time credit —
It 'time to give back to BOP inmates who follow the rules and stay out of trouble. During the penalty is equal to 15% of the time elapsed. Anyone sentenced to 12 months or less, will qualify for good time credit is not. Therefore, the sentences of 12 months and 1 day is often provided. The law is a way to show a little 'clemency.
Not onlydeduction of 15% of the sentence, BOP has chosen to use a couple of interesting logic to interpret the significance of 15%. This is studied in detail later. This usually means that the deduction of 15% of the total length condemnation misunderstanding will lead to a precise calculation of good time credit is not granted.
2.Residential Drug Abuse Program (RDAP) —

3.Halfway House —

A prisoner is entitled to a house in the middle with the remaining 10% of their penisor 6 months if 10% over 6 months. Time Halfweghuis is based on actual time served, not on the total length of the sentence. When a prisoner is entitled to a halfway house, he or she is in no way guaranteed immediate placement. But, especially in the convictions of more than 12 months, a couple Halfway House time is expected. Now Halfweghuis are extremely rare in sentences of less than 6 months.
4.Time already served —
So already in police custodyawaiting trial or during transportation to the designated prison, to be deducted. This time is subtracted after the calculations above, if that sentence was 366 days and the actual time to be served, 319 days and the time has already been 3 days, 3 days would be deducted from the non-319 366
The calculation of good time credit is granted, is probably the most complicated and difficult than the above four steps. This is because, while SentencingGuidelines called for proper execution of a prisoner serving 85% of his sentence, BOP chose to interpret differently. Instead of simply pulling the 15% of the sentence, BOP decided to found a reduction of the time would be served by the system of penalties and credit first time.
In 1987, the Sentencing Commission staff, with the task of working to create a baseline for the Sentencing Table, where all federal sentences wouldreference. They have a wide range of sentences to be collected for a wide range of crime and to determine the actual time served as a baseline. When the sentence was more than 12 months, divided by the Commission so the phrases in Table 85 Levels of Good Time Credit is used, similar to those used in the new guidelines.
Basically, the MDP can to meet the new guidelines, but to keep prisoners in custody beyond the timemany supporters insist that the intent of these policies.
